Trusts

A trust typically allows assets to be transferred immediately upon death without court supervision and without the need for probate. The basic concept of a trust is that assets are "owned" by the trust, not the individual. The individual creates a trust in his or her lifetime, controls the assets as the initial trustee, and specifies to the named successor trustee, to handle the disposition of assets upon death.

Wills

A will allows you to specify your desires for matters that are not specified in the trust. For instance, a will can address burial or cremation directives, the disposition of personal items, or the distribution of any assets not specifically addressed in the trust.
